1. Introduction and Purpose
This DMCA & Abuse Policy explains how Spantrix Limited receives, reviews, and responds to copyright complaints, DMCA-style notices, counter-notices, trademark complaints, general abuse reports, emergency abuse reports, and law-enforcement or legal requests.
Spantrix Limited is based in Nigeria. References to DMCA-style notices are provided for convenience because many copyright complaints in the hosting industry follow that structure. Spantrix Limited may also process copyright, intellectual-property, and abuse complaints under Nigerian law, applicable local law, hosting-provider obligations, registry and registrar rules, upstream-provider requirements, and court or law-enforcement requirements.
2. Scope and Relationship With Other Policies
This policy applies to websites, servers, IP addresses, domains, DNS, email, reseller accounts, hosted content, backups, security services, and related services provided by Spantrix Limited.
This policy should be read with the Terms of Service and Acceptable Use Policy. Spantrix Limited may act under those documents even if a report does not meet all requirements in this policy.
Spantrix Limited does not provide legal advice and does not adjudicate every private dispute. Parties should seek independent legal advice where rights, ownership, defamation, privacy, trademark, copyright, business, employment, or contractual disputes are involved.
3. Copyright Infringement Complaints
A copyright owner or authorized agent may submit a copyright complaint requesting removal or disabling of access to allegedly infringing material hosted through Spantrix services.
A complete DMCA-style takedown notice should include the complainant’s signature, identification of the copyrighted work, identification of the allegedly infringing material, the exact URL or location of the material, complainant contact information, a good-faith statement, and a statement that the information is accurate and the complainant is authorized to act.
Copyright complaints should be sent to the designated copyright/DMCA contact at abuse@spantrix.com, with the subject line “Copyright Complaint - [domain or URL]”. Spantrix Limited may maintain a designated DMCA agent if required or appropriate and should insert the agent’s name, address, phone, email, and registration details before publication.
Incomplete notices may be rejected, delayed, or returned for more information. Misrepresentations in complaints may create legal liability for the complainant.
4. Review, Removal, Disabling Access, and Customer Notice
Spantrix Limited may review notices for completeness, apparent authority, hosted location, evidence, technical feasibility, and risk. Review does not mean Spantrix Limited accepts the merits of the complaint.
Spantrix Limited may remove material, disable access, suspend a service, restrict a domain, notify the customer, forward the complaint, request a response, or take other action it considers appropriate.
Where appropriate and lawful, Spantrix Limited may notify the affected customer and provide a copy or summary of the complaint. Notice may be delayed or withheld where prohibited by law, legal process, emergency, security risk, child-safety risk, phishing risk, malware risk, or upstream-provider instruction.
5. Counter-Notification Process
A customer who believes material was removed or disabled because of mistake or misidentification may submit a counter-notice using the template in this policy.
A complete counter-notice should include the customer’s signature, identification of the removed or disabled material, the previous location of the material, a good-faith mistake or misidentification statement, contact details, and a jurisdiction or dispute-process statement where relevant.
Spantrix Limited may forward a counter-notice to the complainant where appropriate. Spantrix Limited may restore material when legally appropriate, operationally feasible, and not prohibited by court order, registry or registrar instruction, upstream-provider requirement, law-enforcement request, service policy, or continuing abuse risk.
6. Court Orders, Legal Proceedings, and Repeat Infringers
Spantrix Limited will comply with valid court orders, injunctions, subpoenas, regulatory orders, registrar or registry instructions, and other binding legal process where applicable.
Spantrix Limited may terminate or restrict accounts of repeat infringers or customers repeatedly associated with copyright complaints, trademark complaints, abusive conduct, unlawful content, or policy breaches.
Spantrix Limited accommodates and does not intentionally interfere with standard technical measures used by copyright owners to identify or protect copyrighted works where those measures are lawful, technically feasible, and do not impose unreasonable burden on Spantrix Limited’s systems.
7. Trademark and Other Intellectual Property Complaints
Trademark, design, trade secret, publicity right, and other intellectual-property complaints should identify the right claimed, registration or ownership basis, exact URLs or domains, alleged infringement, requested action, complainant authority, and contact information.
Spantrix Limited may request a court order, registry process, registrar process, dispute-resolution decision, or further evidence before acting on complex ownership, reseller, partnership, marketplace, fair-use, comparative-use, or private commercial disputes.
8. General Abuse Reports
Abuse reports may involve phishing, malware, spam, botnets, scams, impersonation, network attacks, DDoS activity, brute-force attacks, credential stuffing, unlawful content, child-safety issues, resource abuse, open relays, open proxies, compromised websites, or violations of the Acceptable Use Policy.
Reports should include the domain, URL, IP address, hostname, date and time with timezone, description, logs, screenshots, packet captures, email headers for spam, affected account information, and any other evidence that helps Spantrix Limited verify and locate the issue.
Emergency abuse reports involving active phishing, malware, attacks, child-safety risk, credible threats, or significant network harm should be clearly marked “URGENT ABUSE REPORT” and sent to abuse@spantrix.com.
9. Law-Enforcement and Legal Request Routing
Law-enforcement agencies, regulators, courts, and legal representatives should route legal requests to abuse@spantrix.com or [legal@spantrix.com if created]. Requests should include agency or requesting party details, officer or representative name, badge or reference number where applicable, legal authority, case reference, requested information, deadline, contact details, and required legal documentation.
Preservation requests should identify the account, domain, IP address, URL, service, relevant date range, legal basis, preservation period, and contact details. Spantrix Limited may preserve information where legally valid, technically feasible, and reasonably identifiable.
Spantrix Limited may notify customers of legal requests where permitted, but may delay or withhold notice where prohibited by law, court order, law-enforcement instruction, emergency, abuse risk, or preservation requirement.
10. False, Abusive, or Incomplete Reports
False, abusive, harassing, automated, incomplete, or bad-faith reports may be rejected or deprioritized. Reporters should not submit personal data, confidential information, or credentials unless necessary for the report.
Spantrix Limited may require additional verification of reporter identity, authority, ownership, evidence, or legal basis before acting.
